MANILA, Philippines – Television host Willie Revillame has opposed ABS-CBN Broadcasting Corp.’s petition to stop the airing of his new show, Willing Willie on TV5.
Joel Bodegon, Revillame’s counsel, said Judge Luisito Cortez of Quezon City regio-nal trial court did not commit grave abuse of discretion when he denied ABS-CBN’s plea for a temporary restraining order.
Revillame told the Court of Appeals ABS-CBN chose to avail of the remedy of certiorari without filing a motion for reconsideration before the trial court.
“A petition for certiorari before a higher court will not prosper unless the inferior court has been given, through a motion for reconsideration, a chance to correct the errors imputed to it,” read Revillame’s pleading.
“The writ of certiorari does not lie where another adequate remedy is available for the correction of the error.”
Revillame’s lawyers asked the CA to set for oral arguments yesterday ABS-CBN’s petition for a TRO and/or the issuance of a writ of preliminary injunction.
“An oral argument on petitioner ABS-CBN’s prayer would ensure the Honorable Court affording the parties to ventilate their respective positions on the matter of the propriety of the issuance or non-issuance of any injunctive relied in the instant case,” read Revillame’s pleading. – With Edu Punay
